Senegal Parliament Passes Bill Doubling Jail Term for Same-Sex Relations

Lawmakers in Senegal have approved legislation that doubles the maximum prison sentence for same-sex relations, tightening the country’s already strict laws on homosexuality.

The bill was passed by the National Assembly of Senegal on Thursday with overwhelming support from lawmakers. Reports indicate that 135 legislators voted in favour, while none voted against and three abstained.

Under the new legislation, the maximum prison sentence for same-sex relations will increase from five years to ten years. The law also raises fines for related offences to as much as 10 million CFA francs, significantly higher than the previous penalties.

The bill further expands sanctions for individuals accused of promoting, financing, or supporting same-sex relationships, with prison terms reportedly ranging from three to seven years.

However, the legislation still requires the assent of President Bassirou Diomaye Faye before it can formally become law.

The measure was introduced under the administration of Prime Minister Ousmane Sonko and reflects a campaign pledge made by the country’s current leadership during the 2024 elections.

Homosexuality was already criminalised in Senegal under Article 319 of the country’s penal code, which previously prescribed prison terms of one to five years along with fines for same-sex relations. The newly passed bill effectively doubles the maximum jail term.

The move has drawn criticism from international human rights organisations and public health advocates, who warn that tougher penalties could increase stigma and discourage individuals from seeking health services, including HIV treatment.

If signed into law, the amendment would make Senegal one of several African countries that have recently strengthened legal penalties related to same-sex relationships.
