Renowned human rights lawyer, Femi Falana (SAN), has declared that the demolition of homes or forced eviction of residents in waterfront communities such as Makoko is illegal, citing a Supreme Court ruling.
Falana made the assertion on Sunday during an interview on Arise Television, where he stressed that Nigerians have constitutional rights to housing and human dignity, which must be respected by government authorities.
He explained that before any demolition can take place, the government is legally required to engage the affected residents and provide alternative accommodation. Falana also condemned the use of tear gas on peaceful protesters, describing it as unlawful and unjustified.
Drawing from over 35 years of legal experience handling demolition-related cases in Lagos, Falana noted that the Supreme Court ruled about two years ago that state governments do not have control over inland waterways. Based on this judgment, he said demolishing homes in waterfront areas is against the law.
Falana emphasised that while development is important, it must be carried out in a humane and lawful manner.
“You cannot invade a community at night, use tear gas, confuse people, and then start destroying their homes. That is not allowed by law,” he said.
He reaffirmed that Nigerians are entitled to dignity and shelter, insisting that any demolition must involve proper consultation and clear resettlement plans.
